Dated 28 Mar 1652. Prob 18 Sept 1652. To wife ELIZABETH land during life "whereupon I am now seated as lyeth within the Neck", the rest to be for the good "of my Sonn NICHOLAS during his minoryty". After wife's death the whole 900 acres to son Nicholas. He failing in heirs "unto CASSANDRA my Daughter." To MARGARET my sister the wife of William Blackey" 860 lb tobo (my note: = tobacco) due from William Burford. Cattle to wife Elizabeth and children Nicholas and Cassandra. Nicholas to be of age at 18 and Cassandra at 20 or day of marriage. A gold ring to each of them. Also other items. Also 1100 lb tobo dur from Geo Smith. To "Mary and Jane the daughters of Elizabeth my wife" 3653 lb tobo "which was reted [my note: = retted] this yeare of Henry Ashwell" [sic.] To "Alce and Elizabeth the Daughters of Elizabeth my wife and att this present liveing in England" all tobo dur from Henry Ashwell by Bill. To "MY BROTHER IN LAW WILLIAM BLACKLEY my Beaver hatt". Residue of estate to wife Elizabeth, she executrix. Brother William Blackley overseer of estate. Bees Humphrey released from servitude "in Recompence of any former neglect". Signed Thomas Gybson. Wit: Bees Hughes, Jno Whiston his marke. Proved by oathes of Hughes and Whiston 18 Sept 1652. Wm Blackley made oath 25 Sept 1652 before Capt Nicho: Martian [= Martiau,] Mr. John Chew and Capt Wm Barber that this was the last will and testament of Thomas Gybson. Rec. 20 Sept 1652 by Tho. Ballard, Cur. Clerk.

NOTE:
Richard Bennett (August 6, 1609 - April 12, 1675) was a British Colonial Governor of Virginia.
Born in Wiveliscombe, Somerset, Bennett served as governor from April 30, 1652, until March 2, 1655.[1][2] His uncle, Edward Bennett, was a wealthy merchant from London and also a member of the Virginia Company. Bennett traveled to the colony as a representative of his uncle's business interests, and quickly rose to prominence, serving in the House of Burgesses in 1629 and 1631.[3] On November 30, 1657, Bennett signed the treaty with Cecilius Calvert, 2nd Baron Baltimore, which recognized the latter's claim to Maryland.[2] While little is known about his time as governor, it is believed that he was popular with the colonists.[3]
Bennett was an ancestor of Henry Lee III, Robert E. Lee and John Randolph of Roanoke.[4]

• Note: escheat. Escheat is a common law doctrine that operates to ensure that property is not left in limbo and ownerless. It originally referred to a number of situations where a legal interest in land was destroyed by operation of law , so that the ownership of the land reverted to the immediately superior feudal lord.
